2. Definition of "Personal Data"


According to Art. 4 of the GDPR, "personal data" is "all information that relates to an identified or identifiable natural person". For this purpose, a natural person who can be identified directly or indirectly, in particular, by means of assigning an identifier such as a name, an identification number, location data, an online identifier, or one or more special features shall be regarded as identifiable.


3. Personal Data Processing


If you visit our website, we only collect the data that your browser transmits to our server.


These are necessary to display Yespshop and to ensure stability and security: IP address, date and time of the request, content of the request (actual page), access status/HTTP status code, amount of data transferred, website from which the request came, browser, operating system and its interface, language and the version of the browser software.


It is not possible to draw any conclusions about the respective person on the basis of this data. This data is processed on the basis of Art. 6 Para. 1 Cl. 1 lit. f of the GDPR. We store this data for reasons of technical security, e.g. to ward off attacks on the web server, whereby after 7 days at the latest, the data is anonymized by shortening the IP address at domain level, so that it is not possible to establish a reference to the individual website user.
 
If you have made your data available to us by yourself, e.g. in the context of registrations, filling out forms or inquiries, your data will only be collected, processed, used and passed on, if this is necessary to process your request and if you have given your consent, respectively.


If you have registered for our newsletter, your personal data will be used for advertising purposes and processed for sending the newsletter, but not made available to third parties. The newsletter can contain promotions, notices of events, news, products or other information. You can unsubscribe from receiving the newsletter at any time with ex nunc effect by using the unsubscribe link (which can be found in every newsletter), sending us an e-mail to info@yespshop.com, or sending us your unsubscribe application by post.


 In the event that you send us personal data in the form of application documents electronically, we will process and use this information exclusively to carry out the application process and to possibly initiate an employment relationship.  When the period stated by law expires, we will delete your application documents from the system, unless you expressly agree in writing to keep them for a longer period. It is the only case when your application documents will be passed on to the third parties, if you expressly authorize us to do so in writing by specifying the recipient.


Your data will be deleted when storage is no longer required for the purposes described in this Privacy Policy and legal provisions do not prescribe a longer retention period.


4. Web Analytics

4.1 Google Analytics


Yespshop uses Google Analytics, a web analysis service by Google Inc (1600 Amphitheatre Parkway Mountain View, CA 94043, USA; Google). The usage includes the Universal Analytics operating mode. This makes it possible to assign data, sessions and interactions across multiple devices to a pseudonymous user ID and thus to analyze the activities of a user across devices.
Google Analytics uses so-called “cookies”, text files that are stored on your computer and that enable your use of the website to be analyzed. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. If IP anonymization is activated on this website, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the EEA Agreement. The full IP address only is transmitted to a Google server in the USA and shortened there in exceptional cases. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide the website operator with other services relating to website activity and internet usage. Our legitimate interest in data processing also lies in these purposes.
The legal basis for the use of Google Analytics is §15 Para. 3 of the TMG (German Teleservices Act) or Art. 6 Para. 1 lit. f of the GDPR. The data sent by us and linked to cookies, user IDs (e.g. User ID) or advertising IDs are automatically deleted after 14 months. The deletion of data whose retention period has expired takes place automatically once a month. You can prevent the storage of cookies by setting your browser software accordingly; however, we would like to point out that in this case you may not be able to use all functions of this website to their full extent.
